Consumer group CHOICE says consumers who purchased a Samsung Galaxy Note7 phone outright should seek an immediate refund following the global tech giant’s failed product launch which has seen 35 incidents around the world.
“Learn from Samsung’s flawed washing machine recall and don’t mess around with a repair or a replacement – seek a full refund. The fact is you don’t want one of these flaming devices in your pocket,” says CHOICE Head of Media Tom Godfrey.
“We are aware of one alleged incident in Perth that saw a Samsung device fail, leaving burn marks on a hotel bed and carpet. CHOICE understands Samsung is investigating a number of incidents across Australia.
“Regardless of what the company claims, if you are in any way concerned about your new Samsung Note7 don’t hesitate to put yourself and your family first and seek a remedy.
“A dangerous phone like this is considered to have a major failure under consumer law, which means the consumer decides what remedy – a repair, replacement or refund – is right for them.
“If you have purchased one of these phones outright, your best option is to get an immediate refund from Samsung or the place of purchase.
“It’s a different story if the phone comes as part of a contract for service with a telco. In this instance, if the service can no longer be provided because the phone is dangerous, you might have a right under the guarantees within consumer law to cancel the service.
“It could be argued that if a telco is advertising a specific ‘Samsung phone package’, consumers expect that in purchasing the product, they will get the named Samsung phone to use for the duration of the contract.
“It’s worth remembering that if you are not satisfied with the remedy offered by a telecommunications company like Telstra or Optus, you can always escalate the issue to the Telecommunications Industry Ombudsman.
“Whatever remedy you select, stop using the phone immediately.
