GAME OF SKILL PRIZE – RULES, TERMS AND CONDITIONS

The Promoter

  1. The Promoter is the Global Travel Media, Sydney, NSW 2000, Australia, ABN: 45 141 184 198

The Competition

  1. This is a game of skill, with chance playing no part in determining the winner.
  2. The Promoter reserves the right to withdraw or amend the competition as necessary at any time.

Entries

  1. Each entry will be individually judged, by a judge appointed by the Promoter, based upon the answers provided.
  2. All entries must be an independent creation by the entrant and free of any claims that they infringe any third party rights.
  3. Employees of the promoter and agencies or any companies considered to be associated with this promotion are ineligible to enter the competition, as are their immediate families.
  4. To enter, entrants must be subscribers to and recipients of www.eglobaltravelmedia.com and to have completed the entry form as requested.
  5. Only one entry is permitted per person.
  6. Only trade entries will be considered as entries, with the determination of whether the entry and/or winner is trade at the absolute discretion and determination of the promoters and the judge, with their decision being final.
  7. All entries and any material produced by the winner become and remain the property of the promoter and agencies associated with this promotion.
  8. The promoters reserve the right to verify the validity of entries.
  9. The judge reserves the right to disqualify any entrant submitting an entry which, in the opinion of the judge, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The judge’s decision will be final and no correspondence will be entered into.

Winners

  1. Winners of the competition must be 18 years old and over and residents of Australia.
  2. Only trade entries can be winners of this competition, with the determination of whether the entry and/or winner is trade at the discretion and determination of the promoters and the judge, with their decision being final.

The Prize

  1. The Promoter will coordinate the itinerary for the prize winner, with the Promoter’s decision in relation to the final itinerary deemed final with no correspondence in that regard entered into.
  2. The prize is non-transferable and non-redeemable for cash at any time.
  3. Any attempt to pass on, resell or auction all or any part of this prize will result in an immediate cancellation of the prize.
  4. The prize itinerary as determined by the Promoter and prize partners cannot be exchanged for another itinerary.
  5. In the event that, for any reason whatsoever, a winner does not take an element of the prize at the time stipulated by the Promoter, that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
  6. The prize is for two people. The second person need not be a member of the trade under Item 9 above, with these terms and conditions except Item 9 also being applicable to the person accompanying the prize winner.
  7. Both parties must travel together.
  8. No correspondence will be entered into with the person accompanying the prize winner.
  9. The various prize elements are being provided by partner prize providers as listed above, with the Promoter not liable for the quality or delivery of the prizes at any time.
  10. The Promoter reserve the right to substitute any component of the prize for an itinerary at their discretion.
  11. The prize cannot be gifted to other persons in lieu of the winner not being able to travel.
  12. The prize must be taken within 12 months of being awarded and will be subject to black out period, e.g. peak holiday periods as determined by and at the discretion of the airline, Promoter and prize partners.
  13. Should the winner not be able to complete all aspects of the itinerary within the period of prize validity, the remaining items shall be forfeited without any replacement for their value.
  14. The prize winner will be required to agree to and sign to any associated booking conditions or terms and conditions as determined by the airline and prize providers, otherwise the prize will be forfeited.
  15. The prize winner and accompanying person are required to obtain the relevant and suitable travel insurance at their own expense in order to be able to take the competition prize and evidence will be required to be provided to the Promoter before the commencement of the prize trip.
  16. It is the prize winner’s and accompanying partner’s personal responsibility to ensure that they have valid documentation, including but not limited to, valid passports, visas and health requirements as deemed necessary by the relevant authorities and advisors, and which meet the requirements of immigration and other government authorities at the destination.
  17. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the prize winner and accompanying partner and not the Promoter or the prize partners.
  18. The prize is provided as determined by and at the absolute discretion of the Promoters, includes 2 return economy flights to Port Vila, Vanuatu from a port in Australia serviced by Air Vanuatu, that is either Brisbane, Sydney, or Melbourne – please see air conditions below, plus transfers, for a trip of between 7 and 10 days and/or as determined by and at the discretion of the Promoters, depending on the prize winner’s availability and availability with partner operators, with one room provided in each accommodation on a shared accommodation basis for the number of nights as determined by  and at the discretion of the promoters and prize partners based on the itinerary as determined by and at the absolute discretion of the Promoters, breakfast every day, some lunches and dinners depending on the prize partners and, tourism activities provided by prize partners and Tourism Vanuatu for 2 people.
  19. Any spending money, additional meals, drinks, insurance, airline and local charges and taxes, passports, visas, extra accommodation, items of a personal nature, inoculations, travel to and from departure point in Australia and New Zealand, additions to stipulated itineraries and offered flights and all other ancillary costs are the responsibility of the winner and/or the accompanying partner.
  20. Unless expressly stated, all other expenses become the responsibility of the winner and/or the accompanying partner.
  21. The promoter shall not be liable for any loss or damage whatsoever which is suffered, including, but not limited to, indirect or consequential loss, or for personal injury which is suffered or sustained, in connection with the prize, and any public liability incurred by the prize winner and/or accompanying partner, except for any liability which cannot be excluded by laws.

General

  1. This promotion commences Monday 20 October, 2014 and entries close 5pm Friday 24 October 2014.
  2. By entering the competition, all entrants will be deemed to have accepted and agreed to be bound by these rules and terms and conditions.
  3. The information entrants and the winner are asked to provide to the Promoter is personal information and is protected by the Privacy Act1988, therefore will not be disclosed to other parties other than in accordance with the Privacy Act 1988.
  4. All entries become the property of the Promoter.
  5. The Promoter may use the entrant’s name as winner for any commercial purpose, including future promotional marketing and publicity purposes.
  6. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
  7. In the event that for any reason whatsoever a winner does not accept the prize or any element of the prize at the time and as stipulated by the promoters or its partners, the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize and the promoters at their discretion may decide to award the prize to another winner.
  8. Entries will be judged in the week commencing 28 October, 2014 and the winner’s name will be published inwww.eglobaltravlemedia.com’s eNews and the winner will be advised and contacted by email and telephone.
  9. If the Promoter is unable to contact the winner within 7 days of the draw and every effort has been made to contact the winner through the information provided by the winner, then the Promoter will award the prize to another valid entrant.  The Promoter’s decision in this regard will be final and no further correspondence will be entered into.
  10. The Judge’s decision will be final and no correspondence will be entered into.
  11. The winner will be required to report for Global Travel Media in articles, images and video clips from each of the places they stay and the experiences they visit and things they do, plus of course their flight to and from Vanuatu with Air Vanuatu.
  12. Acceptance of the competition prize, which will be required in writing, will confirm that the winner acknowledges that they have read and agreed to these conditions.

Air

  1. Air travel for 2 persons from Sydney or Brisbane or Melbourne to Port Vila and to Tanna and return, using Air Vanuatu direct services only (no travel on other airlines or for other routings is included). Note that Melbourne services are seasonal and operate on certain peak dates only.
  2. Travel by both parties must be undertaken on the same flights and dates.
  3. Travel must be completed prior to a date agreed with the airline.
  4. Air Vanuatu may embargo travel during peak periods as decided by the Airline. As a guide, peak periods generally coincide with Australian school holiday periods.
  5. Travel dates are based on availability on the day of booking.
  6. Taxes and charges levied by 3rd parties and collected by Air Vanuatu are the responsibility of the prize winner.
  7. Additional expenses are at prize winners’ expense.
  8. Travel Insurance: It is strongly recommended that travellers hold current and valid travel insurance.
  9. The prize is non‐transferable and cannot be used in conjunction with any other special offer.
  10. An unused prize cannot be assigned to another party, refunded, exchanged or redeemed for cash.
  11. All bookings are subject to the terms and conditions of the operators.
